Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Paranormal Field Kit Android application (the "App"), paranormalfieldkit.app (the "Website"), and related features, content, and support services (collectively, the "Services").

These Terms form an agreement between you and the developer and publisher of Paranormal Field Kit ("Paranormal Field Kit," "we," "us," or "our"). By downloading, purchasing, installing, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of legal majority where you live, you may use the Services only with permission and supervision from a parent or legal guardian who agrees to these Terms.

You may not use the Services if doing so would violate applicable law or if you are legally prohibited from receiving them.

2. License to Use the App

Subject to these Terms and the applicable Google Play rules, Paranormal Field Kit grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the App on devices you own or control.

You may use the App for personal investigations, organized paranormal teams, educational demonstrations, and lawful professional fieldwork. Purchasing or downloading the App gives you a license to use it. It does not transfer ownership of the App, its software, designs, content, trademarks, or other intellectual property.

3. App Purpose and Important Disclaimer

Paranormal Field Kit is designed for paranormal investigation, documentation, experimentation, and entertainment. It includes tools for recording observations, audio, photos, videos, radio sessions, message sessions, and readings from supported phone sensors.

The Services do not establish, verify, or guarantee the existence of paranormal activity. Spirit Messages, SLS-style overlays, Static Watch detections, Estes responses, sensor readings, audio recordings, and other results can be affected by randomness, environmental conditions, radio broadcasts, ordinary sound, lighting, camera behavior, phone movement, hardware limitations, software interpretation, human perception, coincidence, and other non-paranormal causes.

Results should be documented and evaluated critically. They are not scientific proof, professional measurements, medical advice, safety advice, or an emergency-warning system.

4. Investigation Safety

You are responsible for your own safety and for the safety of anyone participating in an investigation.

Do not use the Services in a way that distracts you while driving, operating equipment, walking near traffic, entering unstable structures, exploring restricted areas, or moving through dark or hazardous environments. Do not rely on the App to detect people, threats, structural hazards, dangerous gases, electrical hazards, weather emergencies, or medical conditions.

Use appropriate lighting, protective equipment, communication methods, emergency plans, and dedicated safety instruments. Follow property rules and instructions from owners, venue staff, emergency personnel, and public authorities.

5. Recording, Privacy, and Property Rights

You are responsible for obtaining all permissions and consents required for your investigation. Laws governing audio recording, photography, video recording, surveillance, location information, and private conversations vary by jurisdiction.

Before recording or monitoring, you must:

  • Obtain permission to enter and investigate the property.
  • Obtain consent from people whose voices, images, or personal information may be recorded when required by law.
  • Respect posted rules, restricted areas, and reasonable expectations of privacy.
  • Avoid recording minors without permission from a parent or legal guardian.
  • Avoid publishing addresses, coordinates, faces, voices, or sensitive information without authorization.

Paranormal Field Kit does not grant you permission to enter property, record another person, or distribute investigation media.

6. Your Sessions, Recordings, and Other Content

You retain any rights you have in session notes, recordings, photos, videos, exports, and other content you create through the App ("User Content"). The App stores investigation records locally and does not require you to upload User Content to us.

You are responsible for:

  • The legality, accuracy, and content of your investigation records.
  • Reviewing files before saving, exporting, publishing, or sharing them.
  • Protecting confidential locations and information.
  • Maintaining any backups you want to keep.
  • Securing your device and exported files.

The App's private data is excluded from Android cloud backup and device-transfer backup. Sessions may be permanently lost if you delete them, clear App storage, uninstall the App, lose the device, or experience device or storage failure without first exporting the information you want to retain.

7. Permissions and Device Capabilities

Some features require access to your camera, microphone, foreground location, storage interface, internet connection, or built-in phone sensors. Android asks for runtime permission where required. You may deny or revoke a permission, but the related feature may not work.

Android phones do not contain identical hardware. Sensor Deck shows only measurements supported by the device. Accuracy, range, sampling rate, camera quality, microphone quality, flashlight availability, temperature sensing, and the ability to run multiple tools at the same time vary by device.

Phone sensor readings are not guaranteed to match dedicated or calibrated scientific instruments.

8. Estes Session and Third-Party Radio Services

Estes Session requires an active internet connection and depends on independent radio-directory and station-streaming services. Live streams may be unavailable, mislabeled, delayed, interrupted, geographically limited, changed, or removed without notice.

Paranormal Field Kit does not own or control third-party broadcasts, Radio Browser servers, individual station streams, internet providers, or the content played through them. Radio fragments may contain speech, music, advertising, opinions, or other content that we do not select or endorse.

Your use of third-party services may be subject to their own terms, privacy practices, regional availability, and legal restrictions. We are not responsible for third-party content, outages, or actions.

9. Purchases, Pricing, and Refunds

Google Play processes App purchases, taxes, payment methods, access rights, and refunds. Prices may vary by country, currency, tax, promotion, and Google Play settings.

Your purchase is subject to the Google Play terms and refund policy that apply to your account and location. Except where required by law or expressly offered by Google Play, purchases are not automatically refundable. To request a refund, use Google Play's refund process or contact us at support@paranormalfieldkit.app for purchase support.

Uninstalling the App does not automatically create or guarantee a refund.

10. Updates and Changes to the Services

We may release updates to improve security, compatibility, performance, design, or features. Updates may modify, add, or remove functionality. Some updates may be required for continued compatibility with Android, Google Play, device hardware, or third-party services.

We do not guarantee that every feature will remain available forever or work on every device. We may suspend or discontinue all or part of the Services when reasonably necessary, subject to applicable law.

11. Acceptable Use

You agree not to:

  • Use the Services for unlawful surveillance, trespassing, harassment, stalking, intimidation, fraud, or invasion of privacy.
  • Record or distribute another person's private communications when doing so is unlawful.
  • Use the Services to make knowingly false, deceptive, defamatory, or harmful claims about another person or property.
  • Present App output as scientifically verified proof when it has not been independently established as such.
  • Upload or distribute malware, harmful code, or content that violates another person's rights.
  • Interfere with the App, Website, radio services, servers, networks, or another user's access.
  • Attempt to bypass security, purchase, license, access-control, or technical restrictions.
  • Copy, modify, distribute, sell, rent, sublicense, or create derivative versions of the App except where applicable law expressly permits it.
  • Reverse engineer, decompile, or attempt to extract source code except to the limited extent such restrictions are prohibited by applicable law.
  • Use Paranormal Field Kit names, logos, screenshots, or branding in a way that falsely suggests endorsement or affiliation.

12. Intellectual Property

The Services, including the App software, visual design, interface, graphics, logos, text, databases, and original content, are owned by or licensed to Paranormal Field Kit and are protected by intellectual-property laws.

"Paranormal Field Kit" and associated logos and branding may not be used without prior written permission except for truthful, non-misleading references to the App, lawful reviews, or uses permitted by applicable law.

Third-party names, content, broadcasts, and trademarks remain the property of their respective owners. Their appearance in or availability through the Services does not imply endorsement.

13. Feedback

If you voluntarily send suggestions, bug reports, or ideas, you grant us permission to use that feedback without restriction or compensation to improve the Services. This does not transfer ownership of your private investigation recordings or media.

Do not include confidential information or third-party personal information in feedback unless it is necessary and you have authority to provide it.

14. Privacy

Our Privacy Policy explains how information is handled when you use the App, Website, radio features, exports, reviews, and support channels. The Privacy Policy is incorporated into these Terms by reference.

15. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. This includes implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and error-free operation.

We do not warrant that:

  • The Services will meet every user's expectations.
  • Any result indicates paranormal activity or communication.
  • Sensor readings, camera overlays, radio content, messages, recordings, or detections will be complete or accurate.
  • The App will work with every device, Android version, accessory, network, or third-party service.
  • Sessions or media will never be corrupted, interrupted, or lost.
  • Defects will always be corrected or third-party services will remain available.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

16. Limitation of Liability

To the maximum extent permitted by law, Paranormal Field Kit and its developer, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, recordings, goodwill, business opportunity, or use, arising from or related to the Services.

To the maximum extent permitted by law, our total liability for all claims arising from or related to the Services will not exceed the greater of:

  1. The amount you paid for the App during the 12 months before the event giving rise to the claim; or
  2. Ten U.S. dollars (US $10).

These limitations apply regardless of the legal theory and even if we were advised that damages were possible. They do not limit liability that cannot legally be excluded or limited, including any non-waivable consumer rights.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Paranormal Field Kit and its developer, affiliates, licensors, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Services, your User Content, your violation of these Terms, your violation of another person's rights, or your failure to obtain required property or recording permission.

This section does not apply where prohibited by applicable consumer law.

18. Suspension and Termination

You may stop using the Services at any time and may uninstall the App. Your license to use the Services automatically ends if you materially violate these Terms.

We may suspend access to Website features or support channels when reasonably necessary to protect users, comply with law, prevent abuse, or maintain the Services. Sections that by their nature should survive termination will remain in effect, including provisions concerning ownership, disclaimers, liability, and disputes.

19. Governing Law

These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict-of-law principles, except where the mandatory laws of your place of residence provide otherwise.

Any dispute that is not subject to a mandatory consumer forum will be brought in a court of competent jurisdiction in Tennessee. Nothing in these Terms removes consumer rights or remedies that cannot legally be waived.

20. Changes to These Terms

We may update these Terms when the Services, applicable law, or business practices change. The Last updated date will identify the current version. If a change materially affects your rights, we may provide additional notice through the App, Website, or Google Play listing when appropriate.

Your continued use of the Services after updated Terms take effect means you accept the revised Terms, except where applicable law requires a different form of consent.

21. General Terms

These Terms and the Privacy Policy are the entire agreement between you and Paranormal Field Kit concerning the Services, except for additional terms imposed by Google Play or another platform you use.

If any provision is found unenforceable, the remaining provisions will remain in effect, and the affected provision will be enforced to the greatest extent allowed by law. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them as part of a reorganization, sale, or transfer of the Services, subject to applicable law.
